29 CFR 1926.1101(g)(11)(i): Before work began and as needed during the job, a competent person who was capable of identifying asbestos hazards in the workplace and selecting the appropriate control strategy for asbestos exposure and who had the authority to take prompt corrective measures to eliminate such hazards did not conduct an inspection of the worksite and did not determine that the roofing material was intact and was likely to remain intact: a) On or about August 21, 2019, and at times prior, the exposing employer, El Roble Roofing, did not ensure a competent person performed an exposure assessment of roofing materials so as to identify the presence of asbestos before starting and during a re-roofing project where asbestos-containing materials were to be removed. As such, employees of El Roble Roofing engaged in the removal of asbestos-containing roofing material without protective equipment or measures in place.

29 CFR 1926.1101(g)(11)(ii): All employees performing work covered by 29 CFR 1926.1101(g)(11) were not trained in a training program that meet the requirements of 29 CFR 1926.1101(k)(9)(viii): a) On or about August 21, 2019, and at times prior, the exposing employer, El Roble Roofing, did not ensure each employee engaged in the removal of asbestos-containing roofing material had received appropriate training to safety carry out this work. Employees were required to remove these roofing materials without protective equipment or measures in place, including the required training, and in doing so, were exposed to asbestos fibers.

29 CFR 1926.1101(g)(11)(iv): Asbestos-containing roofing material that has been removed from a roof, shall not be dropped or thrown to the ground. Unless the material is carried or passed to the ground by hand, it shall be lowered to the ground via covered, dust-tight chute, crane or hoist. All such material shall be removed from the roof as soon as is practicable, but in any event no later than the end of the work shift: a) On or about August 21, 2019, and at times prior, the exposing employer, El Roble Roofing, did not ensure employees, who were required to engage in the removal of asbestos-containing roofing material, were protected from exposure to asbestos fibers by correctly disposing of all removed asbestos-containing roofing materials.

29 CFR 1926.1101(k)(3)(ii)(B): Before work under this standard is performed, employers of employees who will perform such work shall inform the employees of the location and quantity of asbestos-containing material and/or presumed asbestos-containing material present in the area and the precautions to be taken to insure that airborne asbestos is confined to the area. The employer did not inform employers of employees who worked and/or were working in adjacent areas of the location and quantity of asbestos-containing material and/or presumed asbestos-containing material present in the area: a) On or about August 21, 2019, and at times prior, the exposing employer, El Roble Roofing, did not inform employees of the location and quantity of asbestos-containing material prior to employee engagement in the removal of asbestos-containing roofing material. In addition, El Roble Roofing did not inform employers of employees who worked and/or were working in adjacent areas, of the location and quantity of asbestos-containing material when it was being removed from the worksite roof.
