29 CFR 1926.453(b)(2)(v):   A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  a)  54 North Main Street, Wharton, NJ.  A foreman working in a telescopic boom aerial lift was exposed to ejection-type falls from the lift's basket as no fall protection or restraint systems were being used.                                                  Violation observed on or about 08/22/2020.

29 CFR 1926.501(b)(1):   Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  a)  54 North Main Street, Wharton, NJ.  A foreman and laborer working from the roof of this multistory building were exposed to falls of at least 46 feet to the ground below as they were exposed to falls from the edge of the roof, from a clock tower's ledge and from the area of a parapet wall which was only 27 inches high and no fall protection was being used.                                                  Violation observed on or about 08/22/2020.

29 CFR 1926.501(b)(4)(i):   Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes:  a)  54 North Main Street, Wharton, NJ.  A foreman and laborer working from the roof of this multistory building were exposed to falls of over 6 feet to the third floor below as the hatch of the stairway to the roof was left open making it an open hole on the roof surface.                                                  Violation observed on or about 08/22/2020.

29 CFR 1926.502(d)(15):   Anchorage used for attachment for personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached nor was it designed, installed and used as follows: As part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person:   a)  54 North Main Street, Wharton, NJ.  A foreman and laborer working from the roof of this multistory building were exposed to falls of 46 feet the ground below as when they decided to use their fall protection equipment, they anchored 2 lifelines to a single piece of lightweight metal serving as a snow or ice guard on the roof.                                                  Violation observed on or about 08/22/2020.

A foreman and laborer were exposed to fall hazards as they had not received training and/or instruction on recognizing and minimizing their exposure to falls.
