29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.    On or about August 28, 2019, at the previously addressed job site, the portable ladder(s) used to access the roof did not extend at least three (3') feet above the upper landing surface, thereby exposing employees to the hazards associated with falls.    Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):      On or about August 28, 2019, at the previously addressed job site, employees performing residential roofing operations, at more than 20 feet above the ground, were not protected from falls, thereby exposing the employees to fall hazards.   Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).   To abate this hazard in the future, the employer must ensure that employees are protected from the hazard of falling by the use of fall protection devices.    This employer has been previously cited for this practice that included:   Alberto Villa dba Dantes Roofing was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 1399386, citation number 1, item number 1 and was affirmed as a final order on July 16, 2019, with respect to a workplace located at 1613-1619 McKenna Blvd, Madison, WI 53711.    Alberto Villa dba Dantes Roofing was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1270036, citation number 1, item number 2 and was affirmed as a final order on January 16, 2018, with respect to a workplace located at 33626 Valley Lane, Lone Rock, WI 53556.    Alberto Villa dba Dantes Roofing was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1265534, citation number 1, item number 2 and was affirmed as a final order on January 16, 2018, with respect to a workplace located at 342 Prairie Heights Drive, Verona, WI 53593.    Pursuant to 29 C.F.R. 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards.
