29 CFR 1910.212(a)(1): The employer did not ensure one or more methods of machine guarding was provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, in-going nip points, rotating parts, flying chips and sparks:    (a)Orion Food Systems, LLC at 2404 Marietta Place in Sioux Falls, SD 57015: On or about or at times prior to August 23, 2019, the employer did not ensure employees were protected from pinch-point hazards by the use of appropriate guarding methods on the Adamatic Divider-Rounder Machine #0326 in the bakery area. The guard near the hopper motor did not appropriately cover moving components. This condition exposed employees to pinch-point hazards.     (b)Orion Food Systems, LLC at 2404 Marietta Place in Sioux Falls, SD 57015: On or about or at times prior to August 23, 2019, the employer did not ensure employees were protected from caught-by hazards by use of appropriate guarding methods on Dough Knock-Down presses #0706 and #0708. The expanded metal fence guards on both dough knock-down presses were not secured and were freely movable. This condition exposed employees to caught-by hazards.     (c)Orion Food Systems, LLC at 2404 Marietta Place in Sioux Falls, SD 57015: On or about and at times prior to August 23, 2019, the employer did not ensure employees were protected from the pinch-point hazards by use of appropriate guarding methods when performing work with or near the drum access door on the Adamatic Dough Divider-Rounder #326 machine in the bakery area. The interlock for the access door was inoperable and the door latch was not functional. The machine was observed running with the door open. This condition exposed employees to pinch-point hazards.

A conveyor that typically moves trays from the machine to an adjacent station was damaged and had been removed causing an employee to manually move the trays while in close proximity to the press. This condition exposed an employee to crushing hazards associated with the point of operation of the knock down press.

Abatement Note:  The training shall include the following:       (1)Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.       (2)Each affected employee shall be instructed in the purpose and use of the energy control procedure.       (3)All other employees whose work operations are or may be in an area where energy control procedures may be utilized, shall be instructed about the procedure, and about the prohibition relating to attempts to restart or re-energize machines or equipment which are locked out or tagged out.
