29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On or about August 24, 2019, the employer did not ensure that each employee(s) engaged in residential construction activities 6 feet or more above lower levels were protected by guardrails, safety nets, or personal fall arrest systems. Employees of Rubios Roofing LLC, were exposed to fall hazards of up to 10 feet while engaged in roofing activities on the roof of a residential house. The employees were not using fall protection equipment. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet)

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access: a) On or about August 24, 2019, the employer did not ensure that portable ladders, used to access upper landing surfaces, extend at least 3 feet above the upper landing surface to which the ladders were used to gain access. Employees of Rubios Roofing LLC were observed using a ladder to access the roof while roofing a residential building. Ladder did not extend at least 3 feet above the landing platform and was not secured to the structure. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
