29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection.  On August 29, 2019, at 40 Harbert Drive, Dayton, a strip mall with 3 retail spaces under construction, the employer had not provided and installed a fall protection system before installing trusses where employees were exposed to a 12 ft. fall hazard.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  The employer had not provided a training program for employees exposed to fall hazards while setting wood trusses on the roof structure of a strip mall building under construction at 40 Harbert Drive, Beavercreek, OH

Note: The requirements applicable to construction work under this paragraph are identical to those set forth at ��1910.178(l) of this chapter. [44 FR 8577, Feb. 9, 1979; 44 FR 20940, Apr. 6, 1979, as amended at 58 FR 35183, June 30, 1993; 63 FR 66274, Dec. 1, 1998]  On August 29, 2019 at 40 Harbert Drive, Beavercreek, a strip mall building under construction, a rough terrain forklift operator had not been trained and certified prior to lifting wood trusses onto the roof the building for placement on the roof structure.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On August 29, 2019, at 40 Harbert Drive, Dayton, a strip mall building under construction, two employees were exposed to a 12 ft. fall hazard while setting flat wood trusses one employee standing on a truss already secured and one employee standing on the steel beam on the edge of this portion of the building without utilizing any fall protection.   Larry "James Reed" Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR1926.501(b)(1), which was contained in OSHA inspection number 1006516, citation number 1, item number 1 and was affirmed as a final order on January 9, 2015, with respect to a workplace located at 321 Xenia Ave, Yellow Springs, OH 45387.
