29 CFR 1910.178(l)(4)(ii)(D): Refresher training in relevant topics was not provided to the operator when the operator was assigned to drive a different type of truck: On or about August 30, 2019, the employer failed to ensure that refresher training, including an evaluation of the effectiveness of that training, was conducted to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely when operators were assigned to drive a Crown ST3000-20 walk behind motorized hand truck.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily: On or about August 30, 2019, the employer failed to ensure all industrial trucks were examined before being placed in service when the Crown ST3000-20 motorized walk behind hand truck was inspected sporadically before use.
