29 CFR 1926.501(b)(13): Each employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):       (a)K&S Construction at 1703 Sioux Trail, Brookings, SD 57106: On or about and at times prior to September 22, 2019, the exposing employer did not ensure that employees were protected from falls while conducting framing operations. Employees were engaged in setting roof trusses while standing on the exterior top plate exposed to fall hazards in excess of six feet. On September 22, 2019, an employee fell and sustained serious injuries while conducting floor sheathing operations on a two-story single family home. This condition exposed employees to a fall hazard of approximately nine feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:     (a)K&S Construction at 1703 Sioux Trail, Brookings, SD 57106: On or about and at times prior to September 22, 2019, the exposing employer did not ensure that each employee engaged in framing operations on a new single-family home, had been trained to recognize the hazards associated with working at elevations over six feet. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over six feet. The condition exposed employees to the hazard of falling from an elevation of approximately nine feet.

29 CFR 1904.39(a)(2): Employer failed to report, within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, employer did not report the in-patient hospitalization, amputation, or loss of an eye to OSHA:       (a)K&S Construction at 1703 Sioux Trail, Brookings, SD 57006: On or about and at times prior to September 22, 2019, the employer did not report an in-patient hospitalization of an employee who was severely injured. An employee was hospitalized with two fractured ribs and a punctured lung from a fall on a construction site. The employer failed to notify OSHA within 24 hours that an employee was injured and required in-patient hospitalization.       Abatement Required: All work-related in-patient hospitalizations, amputations and losses of an eye must be reported to the Occupational Safety and Health Administration within 24 hours of learning about the injury.  The report must include the following:     1.  Company Name   2.  Location of work-related incident   3.  Time of work-related incident   4.  Type of reportable event (amputation, loss of eye, in-hospitalization)   5.  Number of employees who suffered the event   6.  Names of the employees who suffered the event   7.  Name of a company management official and contact information   8.  Brief description of work-related incident       If the area office is closed, you must report any in-patient hospitalization, amputation, or loss of an eye by using either the 800 (1-800-321-OSHA) number or the reporting application located on OSHA's public web site at www.osha.gov.
