29 CFR 1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:    a) Worksite: Employees repairing water leakage on the edge of the pitched roof approximately 40 ft. above the ground were not using any fall protection; on or about 8/30/19.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access:    A.           On or about 08/30/19, on the ground of 43-37 249th Street. Little Neck, NY      Employees were using a portable ladder to gain access to a roof. The ladder side rails extended less than two foot above the upper landing surface.     B.           On or about 08/30/19, on the lower roof of 43-37 249th Street. Little Neck, NY    Employees were using a portable ladder to gain access to a roof. The ladder side rails extended less than one foot above the upper landing surface.       ABATEMENT VERIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.

29 CFR 1926.1060(a)(1): 1926.1060(a)(1):  The employer did not ensure that each employee was trained by a competent person which would enable each employee to recognize hazards related to ladders and stairs, and the procedures to follow to minimize those hazards.  A.           On or about 08/30/19, at the site of 43-37 249th Street. Little Neck, NY    Employees were not trained to recognize hazards related to ladders by a competent person. The employees used the ladders to gain access that were extend less than 2 ft. above the landing surface to the roof.   ABATEMENT VERIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19.
