29 CFR 1910.243(c)(4): The angular exposure on the grinding wheel periphery and sides for safety guard(s) used on portable grinding machine(s) exceeded 180 degrees:    a) Bella Marble and Granite - On or about August 30, 2019, an employee was exposed to lacerations and eye injuries from flying particles of an abrasive grinding disc, while utilizing a handheld electric grinder to cut screws flush on wooden templates.  The electric grinder was not equipped with the original manufacturer's guard and exposed the employee to 360° of angular exposure to an abrasive grinding disc.   No abatement certification required.  Corrected during inspection.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a) Bella Marble and Granite - On or about August 30, 2019, employees are required to fabricate and grind marble and granite countertops where employees are exposed to hazardous chemicals, such as but not limited to, silica and acetone, and the employer did not develop or maintain a written hazard communication program exposing employees to eye, respiratory, and skin irritation.    Bella Marble and Granite was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1207251, citation number 1, item number 4a, and was affirmed as a final order on 5/2/17, with respect to a workplace located at 50 N. York Rd., Warminster, PA.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.  Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:      a) Bella Marble and Granite - On or about August 30, 2019,  employees were provided half face elastomeric respirators for voluntary use to protect against the inhalation hazards of silica during grinding of marble/granite, and the employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, which would inform and educate employees on the importance of a clean respirator and limitations of its use, as required by this section.     Bella Marble and Granite was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1207251, citation number 2, item number 1, and was affirmed as a final order on 5/2/17, with respect to a workplace located at 50 N.
