29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a)R.C.S. Construction, Inc. at Intersection of North 7th Street and East Jackson Boulevard, Spearfish, SD 57783: On or about and at times prior to August 30, 2019, the exposing employer did not ensure employees were protected from struck-by hazards in that, the spoils pile was not maintained at least 2 feet from the edge of the excavation in areas employees were performing work in the excavation. This condition exposed employees to struck-by hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a)R.C.S. Construction, Inc. at Intersection of North 7th Street and East Jackson Boulevard, Spearfish, SD 57783: On or about and at times prior to August 30, 2019, the exposing employer did not ensure employees were protected from cave-in hazards in that, employees performing work in an excavation greater than 5 feet in depth were not protected from cave-in hazards by an appropriate protective system. This condition exposed employees to cave-in hazards.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a)R.C.S. Construction, Inc. at Intersection of North 7th Street and East Jackson Boulevard, Spearfish, SD 57783: On or about and at times prior to August 30, 2019, the employer did not ensure that daily inspections of a trench that was greater than 5 feet in depth, were made by the competent person for evidence of a situation that could have resulted in a hazardous condition. The competent person did not identify that the trench was greater than five feet in depth, had vertical walls. This condition exposed employees to struck-by hazards and crushing injuries associated with trench wall cave-in.
