29 CFR 1926.201(a): Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition):    (a) Jobsite, 2110 Brighton Road, Pittsburgh, PA:  On or about August 28, 2019 employees who signaled traffic were not wearing garments that conform to the Part VI of the MUTCD nor was any signage or flags used to alert vehicles traveling in the area that equipment had moved into the roadway.  An employee operating an aerial lift needed to reposition the lift and moved it out into the roadway.   A co-worker attempted to stop traffic and was unsuccessful.  A vehicle struck the basket of the aerial lift injuring the operator.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  (The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated):    Jobsite, 2110 Brighton Road, Pittsburgh, PA:  On or before August 28, 2019 employees were working from an aerial lift pressure washing the front of the building and were not wearing a harness and lanyard attached to the boom or the basket.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  (a) Jobsite, 2110 Brighton Road, Pittsburgh, PA:  On or about August 28, 2019 the employer did not provide training to employees who were using an aerial lift to ensure they understood the hazards associated with the type of scaffold being used and how to control or minimize hazards associated with the type of work being performed.  Employees were exposed to hazards such as, but not limited to: fall hazards from not utilizing personal fall protection and struck by hazards from moving the lift into an active traffic area.
