29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   a)  On or about 08/23/19, at the Fairfield Inn & Suites, located on 4333 Federal Drive, in Batavia, New York, the employer did not enforce the use of fall protection while employees were working on an elevated surface (roof top) and exposed to falling 41 feet to a lower level.   NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.502(b)(3): Guardrail systems were not capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied within 2 inches (5.1 cm) of the top edge, in any outward or downward direction, at any point along the top edge:  a)  On or about 08/23/19, at the Fairfield Inn & Suites, located on 4333 Federal Drive, in Batavia, New York, the employer did not maintain a guardrail system to ensure that employees were protected from falling 11 feet to ground level.  The top cross board of the guardrail was broken and not capable of withstanding a force of 200 pounds as required by standard 1926.502(b)(3).  NO ABATREMENT CERTIFICATION REQUIRED
