29 CFR 1926.416(a)(3): Before work is begun the employer shall ascertain by inquiry or direct observation, or by instruments, whether any part of an energized electric power circuit, exposed or concealed, is so located that the performance of the work may bring any person, tool, or machine into physical or electrical contact with the electric power circuit. The employer shall post and maintain proper warning signs where such a circuit exists. The employer shall advise employees of the location of such lines, the hazards involved, and the protective measures to be taken.   a. Located at 1765 Lancaster Newark Road in Lancaster, Ohio: On or about September 4, 2019, employees were tearing off an existing shingle roof and throwing the debris over an energized 220 Volt electrical service entrance, thereby exposing employees to an electrocution hazard. The employer did not assess the work site to determine if employees would be exposed to the electrical circuit during the course of the work and take protective measures.

29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.   a. Located at 1765 Lancaster Newark Road in Lancaster, Ohio: On or about September 4, 2019, the employer did not develop and maintain an effective safety and health program in order to identify and correct hazards onsite while employees were performing roofing work.   Rafeal de la Cruz Resendiz was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1388697, citation number 1, item number 1 and was affirmed as a final order on 06/07/19, with respect to a workplace located at 87 North High Street, New Albany, Ohio.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    a. Located at 1765 Lancaster Newark Road in Lancaster, Ohio: On or about September 4, 2019, employees were removing an existing shingle roof without fall protection, thereby exposing employees to an approximately eleven foot fall hazard.    Rafeal de la Cruz Resendiz was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1388697, citation number 1_, item number 3 and was affirmed as a final order on 06/07/19, with respect to a workplace located at 87 North High Street, New Albany, Ohio.
