29 CFR 1910.178(l)(2)(ii) is applicable to construction employment as referenced by 1926.602(d): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace:  The employer is failing to protect employees from a struck by hazard when operating an all terrain forklift, powered industrial truck, at a residential construction site. This was most recently documented on or about September 4, 2019 at 7337 Straight Street, Lincoln, NE 68521.  Operator of the powered industrial truck had not successfully completed the training required by paragraph (l) of the standard. An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years.

This was most recently documented on or about September 4, 2019 at 7337 Straight Street, Lincoln, NE 68521. Extension cords utilized by employees had sections of insulation that were damaged/worn through exposing the conductors within.

This was most recently documented on or about September 4, 2019 at 7337 Straight Street, Lincoln, NE 68521.  Extension cords utilized by employees had sections of insulation that were damaged/worn through exposing the conductors within.

This was most recently documented on or about September 4, 2019 at 7337 Straight Street, Lincoln, NE 68521.  Employees were observed frame the second level of a residential building at heights greater than six feet above the ground while not utilizing any form of fall protection.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  The employer is failing to train all employees potentially exposed to fall hazards to enable each employee to recognize the hazards associated with the type of work being conducted. This was most recently documented on or about September 4, 2019 at 7337 Straight Street, Lincoln, NE 68521.  This should include training on mitigating those hazards through an acceptable method of fall protection. Employees were observed performing framing activities having not received fall protection training.

This was most recently documented on or about September 4, 2019 at 7337 Straight Street, Lincoln, NE 68521. The top level of an 6-foot step ladder was used by employees to access the upper landing surface.
