29 CFR 1926.102(a)(1): 29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  a) On September 4, 2019, employees were exposed to eye injury hazards while using pneumatic nail guns and portable circular saws to perform carpentry work without the use of appropriate eye protection.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):             a) On or about September 4, 2019, employees were exposed to the hazard of falling approximately 35 feet from a third story deck while performing carpentry work without fall protection.     b) On or about September 4, 2019, employees were exposed to the hazard of falling approximately 25 feet from a second story window/wall opening while performing carpentry work without fall protection.      c) On or about September 4, 2019, employees were exposed to the hazard of falling approximately 12 feet from a third story deck while performing carpentry work without fall protection.
