29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:  a) Moriarty Roofing & Sheet Metal at 1820 Lowell Boulevard in Denver, CO 80206: On or before September 5, 2019, the employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person.  Employees were working on the roof of a middle school without the use of personal fall arrest systems, or without the use of a fall monitoring system with warning lines.  These conditions exposed employees to fall hazards of up to approximately 25 feet.  OSHA defines a "competent person" as someone capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to workers, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system:  a) Moriarty Roofing & Sheet Metal at 1820 Lowell Boulevard in Denver, CO 80204: On or before September 5, 2019, the employer did not ensure that employees were protected from fall hazard while performing tarring work on the roof of Lake Middle School. The employees were performing the roofing work without the use of personal fall arrest systems, or without the use of a fall monitoring system with warning lines.  This condition exposed employees to fall hazards of approximately 25 feet.
