29 CFR 1910.178(l)(1)(i): (Safe operation.) The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  On Sep. 6, 2019, an employee was operating a JCB Loadall 507-42 Telescopic Handler that had not received training required by this subpart.

29 CFR 1926.20(b)(2): (Accident prevention responsibilities.) Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On or about the 3-day period of Sep. 4 - 6, 2019, located at a commercial roof structure, there were no frequent and regular inspections being performed by a competent person in that employees were: using a portable extension ladder as roof access that did not extend 3 feet above the upper landing surface; dumping waste roofing material at the edge of a low-slope roof with unprotected sides and edges while not utilizing a fall protection system; using synthetic straps (that did not have friction protection) being run through holes cut into the sides of a jobsite-made trash box to secure the box to the carriage of a powered industrial truck; and performing roofing work on a low-slope roof structure at potential fall heights of 23 feet above ground level without utilizing a fall protection system.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On Sep. 6, 2019, located on the north side of a commercial roof structure, employees were dumping waste roofing material at the edge of a low-slope roof with unprotected sides and edges while not utilizing a fall protection system and exposed to potential fall heights of 23 feet above ground level.

29 CFR 1926.503(a)(1): ("Training Program.") The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.      The employer did not provide a training program for employees performing work from a low-slope commercial roof structure while not utilizing a fall protection system and exposed to potential fall heights of 23 feet above ground level.
