29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. a) O & S Maintenance - 110 S. West End Blvd., Quakertown, PA, Worksite - On or about August 30, 2019, an employee was dry cutting asphalt roadway with a handheld masonry saw (Table 1 Task). The employer did not properly implement the required engineering controls, work practices, or respiratory protection as specified in table 1 and the employer did not assess exposure limits to silica in accordance with paragraph (d) of this section, exposing the employee to silica inhalation hazards. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

West End Blvd., Quakertown, PA, Worksite - On or about August 30, 2019, an employee was dry cutting asphalt roadway with a handheld masonry saw (Table 1 Task). The employer did not ensure that employees were provided the knowledge and understanding of the health hazards associated with crystalline silica, specific tasks of employees work that could result in exposure to silica, specific measures employees could take to protect themselves, the contents of this section, the identity of the competent person designated by the employer, the purpose and description of medical surveillance, and provide a copy of this section to each employee covered by this section, as specified in (i)(2)(i) (A) through (F). Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
