29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.    A.)  Bradley Paul Bellin dba Bellin Construction, 2100 Pittsburgh Avenue, Erie, PA  16502, north side of the building, on or about September 6, 2019 and times prior thereto:  Employees were performing metal reroofing operations, and were exposed to a fall hazard of 24.1-feet.  The employees were not utilizing guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.    ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED:  Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

29 CFR 1926.761(b): The employer did not train each employee exposed to a fall hazard in accordance with the requirements of 29 CFR 1926.761:  A.)  Bradley Paul Bellin dba Bellin Construction, 2100 Pittsburgh Avenue, Erie, PA  16502, north side of the building, on or about September 6, 2019 and times prior thereto:  Employees were performing metal reroofing operations, and were exposed to a fall hazard of 24.1-feet.  The employees were not wearing personal fall arrest system, positioning device system or fall restraint system, and were not utilizing other means of fall protection.  The employees did not have training on fall hazards and fall protection.   ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:    A.)  Bradley Paul Bellin dba Bellin Construction, 2100 Pittsburgh Avenue, Erie, PA  16502, north side of the building, on or about September 6, 2019 and times prior thereto:  Employees were utilizing a Werner fiberglass ladder to access the roof of the structure.  The ladder was only two-feet above the surface of the roof.  The ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    ABATEMENT CERTIFICATION REQUIRED:  Abatement certification is required within 10 days after the abatement date noted on the citation (see below).
