29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:      a) Production, Cutting: On or about December 12, 2019 and at times prior thereto, employees were exposed to continuous noise at a dose of 122.4% (8-Hour Time Weighted Average sound level of 85 dBA) during the 429 minute sampling period. For a full eight-hour work shift, this exposure is equivalent to an average sound level of 91.4 dBA. Exposure calculations include a zero increment for the 51 minutes not sampled.    b) Production, Shaving: On or about December 12, 2019  and at times prior thereto, employees were exposed to continuous noise at a dose of 110.3% (8-Hour Time Weighted Average sound level of 85 dBA) during the 469 minute sampling period. For a full eight-hour work shift, this exposure is equivalent to an average sound level of 90.7 dBA. Exposure calculations include a zero increment for the 11 minutes not sampled.      c) Production, Washing: On or about December 12, 2019 and at times prior thereto, employees were exposed to continuous noise at a dose of 89.6% (8-Hour Time Weighted Average sound level of 85 dBA) during the 397 minute sampling period. For a full eight-hour work shift, this exposure is equivalent to an average sound level of 89.2 dBA. Exposure calculations include a zero increment for the 83 minutes not sampled.    d) Production, Shackling: On or about December 12, 2019 and at times prior thereto, employees were exposed to continuous noise at a dose of 87.8% (8-Hour Time Weighted Average sound level of 85 dBA) during the 438 minute sampling period. For a full eight-hour work shift, this exposure is equivalent to an average sound level of 89.0 dBA. Exposure calculations include a zero increment for the 42 minutes not sampled.    e) Production, Hot Bath: On or about December 12, 2019 and at times prior thereto, employees were exposed to continuous noise at a dose of 83.8% (8-Hour Time Weighted Average sound level of 85 dBA) during the 443 minute sampling period. For a full eight-hour work shift, this exposure is equivalent to an average sound level of 88.7 dBA. Exposure calculations include a zero increment for the 37 minutes not sampled.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):     a)  On or about September 06, 2019, and at times prior thereto, employees were exposed to corrosive chemical liquids while using ZEP FS Formula 2762 to clean without an assessment to determine the use of eye or face protection    b)  On or about September 06, 2019, and at times prior thereto, employees were exposed to corrosive chemical liquids while using XG-940 to sanitize equipment and pig carcasses without an assessment to determine the use of eye or face protection    c)  On or about September 06, 2019, and at times prior thereto, employees were exposed to corrosive chemical liquids while using ZEP FS Formula 2762 to clean without an assessment to determine the use of hand protection.     d)  On or about September 06, 2019, and at times prior thereto, employees were exposed to corrosive chemical liquids while using XG-940 to sanitize equipment and pig carcasses without an assessment to determine the use of hand protection.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):     On or about September 05, 2019, and at times prior thereto, employees were exposed to chemical hazards from chemicals such as, but not limited to ZEP FS Formula 2762, ZEP Formula 4169, ZEP FS Amine Z, and XG-940 without access to a written hazard communication program that incorporated labeling, safety data sheets, and employees information and training.
