29 CFR 1910.22(a)(3): Walking-working surfaces were not maintained free of hazards such as sharp or protruding objects, loose boards, corrosion, leaks, spills, snow, and ice: On or about September 10, 2019, a) Tin Unit Building: Employees used the second deck and steps leading to the TIN Unit control room that were not free from leaks such as (but not limited to) heating oil. b) Tin Filter Building: Employees used the third deck that was not free from spills such as tin shot following repairs to the tin shot/pellet line. c) Tin Filter Building: Employees walked on the third and fourth deck that were not maintained free from corrosion.

29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: guardrail systems, safety net systems, or personal fall arrest systems: a) Tin Filter Building: On or about September 10, 2019, employees used the freight elevator to transport materials without the use of fall protection, where the freight platform was not at the level of the open cage door, up to a height of approximately thirty four (34) feet above ground at the fourth deck.
