29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: (a) Warehouse - On or about September 4, 2019, the employer did not ensure that employees were protected from fall hazards when being raised 4 feet or more to retrieve products, on the forks of a Toyota sit down forklift, while standing on a pallet. In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.
