29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person: (a) Roof above Central Penn Fitness and Aquatics - The employer did not have a competent person on the job site in that none of the employees who worked on the site on September 4, 2019 inspected the job site, identified predictable fall hazards, and took immediate actions to correct the hazards. As a result, employees did roofing work, and either used no fall protection systems or incorrectly implemented fall protection systems, exposing the employees to the hazard of falling about 15 feet to the ground below. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: (a) Roof above Central Penn Fitness and Aquatics - Employees worked on a flat roof to remove stone, and these employees did not use any fall protection system while moving TPO roofing membrane sheets, which served as a debris chute, from the roof's north edge to the roof's west edge, and while dumping wheelbarrows of stone off the roof's west edge, exposing the employees to the hazard of falling about 15 feet to the ground below, on or about September 4, 2019. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.

29 CFR 1926.502(f)(1): Warning lines were not erected around all sides of the roof work area: (a) Roof above Central Penn Fitness and Aquatics - Where employees used a warning line system as fall protection, during the process of removing stone from the roof, the warning line system did not comply with the standard in that the warning line did not extend around the entire roof work area. Specifically, the warning line did not extend around the northwest corner of the building, exposing employees to the hazard of falling about 15 feet to the ground below, on or about September 4, 2019. Corrected during the inspection.

29 CFR 1926.502(f)(1)(iii): Points of access, material handling areas, storage areas, and/or hoisting areas were not connected to the work area by an access path formed by two warning lines: (a) Roof above Central Penn Fitness and Aquatics - Employees used a warning line system as fall protection, during the process of removing stone from the roof, the warning line system did not comply with the standard in that the employer did not install warning lines between the roof work area and the extension ladder used to access the roof and did not install warning lines to form access paths to the edges of the roof where employees dumped stone down into the dumpster, exposing the employees to the hazard of falling 15 feet to the ground below, on or about September 15, 2019. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
