29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.    a) On or about 9/6/19, during commercial roofing activities located at 3984 Porter Rd, Westlake, OH, the employer failed to ensure that the Hyster Challenger 50 forklift serial #D003D0716, used to relocate the roofing materials in the parking lot, had clear and durable load handling control markings in accordance with ANSI B56.1-1969 section 417 paragraph A(3).     b) On or about 9/6/19, during commercial roofing activities located at 3984 Porter Rd, Westlake, OH, the employer failed to ensure that the Hyster Challenger 50 forklift serial #D003D0716, used to relocate the roofing materials, was provided with an operator controlled sound producing device, such as a horn, in accordance with ANSI B56.1-1969, section 427.    c) On or about 9/6/19, during commercial roofing activities located at 3984 Porter Rd, Westlake, OH, the employer failed to ensure that the Hyster Challenger 50 forklift serial #D003D0716, used to relocate the roofing materials in the parking lot, was taken out of service when defects were discovered in accordance with ANSI 56.1-1969 section 606 paragraph A. The forklift was missing a horn, the load handling controls were missing markings, and one of the LPG tank straps was broken and disconnected.     d) On or about 9/6/19, during commercial roofing activities located at 3984 Porter Rd, Westlake, OH, the employer failed to ensure that the Hyster Challenger 50 forklift serial #D003D0716, used to relocate the roofing materials in the parking lot, was checked for fuel system deficiencies in accordance with ANSI 56.1-1969 section 702 paragraph L. One of the LPG tank straps was broken and disconnected.
