29 CFR 1910.212(a)(3)(ii): Point of operation guards were not designed and constructed as to prevent the operator from having any part of their body in the danger zone during the operating cycle: On or about August 21, 2019, for the Rockwell Delta band saw #6 used for Trilogy part #ON30, the employer did not ensure that machine guarding was adequate and that employees appropriately used the existing guide tool to prevent contact with the point of operation. An employee sustained an amputation when pushing a vortex tube through the band saw that was on a custom band saw fixture guide tool..

29 CFR 1904.39(a)(2): The employer failed to report the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, within (24) twenty-four hours: On or about August 21, 2019, the employer failed to report a partial fingertip amputation that was the result of an employee whose finger came into contact with the Rockwell Delta#6 band saw blade that was in operation. The employee was pushing a vortex tube through the band saw that was on a custom band saw fixture.
