29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, and uprights did not bear on base plates and mud sills or other adequate firm foundation:  On September 10, 2019, and at times prior thereto, the employer did not have base plates or mud sills throughout locations where the scaffold was set up on the outside and inside of the new home.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  On or about September 10, 2019, and at times prior thereto, the employees performing masonry activities were not provided with portable ladders, hook-on ladders, attachable ladders to descend  the lower levels and ascend the upper levels of the scaffold, exposing them to fall hazards of approximately 15-feet to the ground.

The employer did not report an in-patient hospitalization that occurred on September 7, 2019, at 575 Wilkinson Drive, Frisco, Texas within 24 hours. The injury was not reported to OSHA until September 9, 2019.
