The PIT, JCB (Model No. 506.36F, Serial No. JCB5CD7GVJ2793680), was used to lift the Bobcat skid steer (S/N A3W618321) into gondola railroad cars.

29 CFR 1910.178(l)(4)(ii)(B): Refresher training in relevant topics was not provided to the operator when the operator was involved in an accident or near-miss incident: 1). On or about August 27, 2019, the employer failed to provide refresher training to the PIT operator(s) involved in an incident which injured an employee. The PIT, JCB (Model No. 506.36F, Serial No. JCB5CD7GVJ2793680) was used to move railroad cars; the PIT was pushing railroad cars down the track #213 and #214 north of building #24 when the forks slipped-away from the railroad car it was pushing and striking an employee, who was subsequently injured. The PIT operator(s) did not receive retraining. 2). On or about November 5, 2019, the employer failed to provide refresher training to the PIT operator(s) involved in an incident in which equipment was damaged. The PIT, JCB (Model No. 506.36F, Serial No. JCB5CD7GVJ2793680) was used to lift a core-straightener into a railroad car when the rigging failed, causing the core-straightener to swing into the windshield of the PIT causing damage. The PIT operator(s) did not receive retraining.
