OSH ACT of 1970 Section (5)(a)(1): Executive Order 12196 Section 1-201(a): The head of the agency did not furnish to employees places and conditions of employment that are free from recognized hazards that are causing or are likely to cause death or serious physical harm in that the employees were exposed to struck by hazards. Location: 2 Journal Square, Jersey City, NJ. On or about 8/30/19; a) An employee was exposed to a fall hazard of approximately 15 ft. to the lower floor when he was permitted to work from a Sky Jack Scissor Lift (Serial # SJ 4632) while on a slope and while a Pro5 fork lift (United Rentals #877185RA) was used to level the Scissor lift as it was in a sloped surface. As per the Scissor Lift operations manual, page 5, under use of equipment; "Work platform elevation and elevated driving must only be done in a firm and leveled surface". The Scissor lift was not on a firm and leveled surface as it was raised by the forklift in order to level it and thus be able to be operated and/or elevated on a sloped area.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) (Construction Reference 1926.602): Location: 2 Journal Square, Jersey City, NJ. a) By not ensuring that those operating the Pro5 forklift (United Rentals #877185RA) forklift had the training and evaluation to safely operate it, the employer placed worker(s) in danger, especially those being elevated in a Sky Jack Scissor Lift (Serial # SJ 4632) with the assistance of the forklift; on or about 8/30/19.
