29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: a) 325 Rt 35 S, Aberdeen, NJ: On or about September 11, 2019, 2 AWT Environmental Services Inc employees entered an 11-13 foot deep excavation. A benching system that was too steep and did not conform to Appendices B, was used. The soil had not been classified as per Appendices A. The Supervisor onsite was not knowledgeable soil classes, soil classification methods and /or proper benching and sloping methods for protective systems. As such, the employer did not ensure that the excavation and protective systems had been properly inspected by an individual meeting the requirements of a competent person (1926.650(b)), thus exposing employees to potential hazards.

29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart. a) 325 Rt 35 S, Aberdeen, NJ: On or about September 11, 2019, 2 AWT Environmental Services Inc employees entered an 11-13 foot deep excavation to install a poly liner. A benching system was selected as protection from cave-in. The excavation benching system was too steep and did not conform to Appendices A and B, exposing employees to potential hazards.
