29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed a training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  A) Henry Graber Sr. (DBA HENRY GRABER CONSTRUCTION LLC/HG CONSTRUCTION/GRABER QUALITY HOMES & AG CONSTRUCTION LLC) on or about August 2, 2019 at the address of 5424 Watkins Road, Saint Henry, OH: The employer failed to ensure that an employee operating a fork truck was adequately trained. The untrained forklift operator, elevated an uneven, unbalanced load (pallet) on the forks, to a receiving platform. The employee fell 32 feet to the concrete ground below while unloading the pallet, when the load shifted.

Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the probability of employee injury and/or illness.

29 CFR 1926.501(b)(3): Each employee in a hoist area was not protected from falling 6 feet (1.8m) or more to lower levels by guardrail systems or personal fall arrest systems   A) Henry Graber Sr. (DBA HENRY GRABER CONSTRUCTION LLC/HG CONSTRUCTION/GRABER QUALITY HOMES & AG CONSTRUCTION LLC) on or about August 2, 2019 at the address of 5424 Watkins Road, Saint Henry, Ohio: The employer did not ensure employees were protected from falls while conducting material handling operations (unloading metal caging rolls) from a pallet, elevated by a rough terrain forklift to the receiving platform of a poultry barn without the benefit of conventional fall protection. The employee fell 32 feet to the concrete ground below, resulting in the employees death due to injuries sustained from the fall.
