29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. A worker conducted framing activities from an aerial lift without fall protection.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. A worker conducted framing activities while working from the hotel driveway canopy without fall protection, at heights greater than 6 feet from the lower level. Sergio Cazares, Sr. was previously cited for a violation of this Occupational Safety and Heath standard, which was contained in OSHA inspection number 1073458, citation number 1, item number 1 and was affirmed as a final order on September 03, 2015, with respect to a workplace located at The Towers Seabrook, 3300 Bayport Blvd., Seabrook, TX 77586.
