29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): On or about 09/17/2019, SAK Construction LLC, located at their job site at 4238 Carr Lane Court, St. Louis, MO, is failing to perform adequate frequent and regular inspections of their surface area at the job site. The surface employees were not adequately monitored during their third shift work (11:00 pm to 7:00 am). The employees are exposed to a variety of hazards which include slip/trips/fall/, pinch points, struck-by, and caught-by.

29 CFR 1926.1424(a)(3)(i): Before an employee goes to a location in the hazard area that is out of view of the operator, the employee (or someone instructed by the employee) must ensure that the operator is informed that he/she is going to that location: On or about 09/17/2019, SAK Construction LLC, located at their job site at 4238 Carr Lane Court, St. Louis, MO, the employer is failing to protect employees from the cranes rotating part(s) hazard (i.e., struck-by and caught-by). With the lack of a specified procedure to enter the barricaded area around the crane, the victim entered a blind spot area of the crane operator. The victim started with the company on 09/09/2019 and received a fatal crushing injury on 09/17/2019. The 9310 American crawler crane (S/N: GS19990) swung around during its operation(s) and the victim was crushed between the cranes track and superstructure.
