A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. On or about September 17, 2019, during the replacement of a fire hydrant at a worksite located at 23537 Lorain Road, North Olmsted, Ohio, the employer did not ensure an employee working inside a trench, with a depth of approximately 5.5 to 6.5 feet was provided with a ladder, ramp or other means of safe egress from the trench.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On or about September 17, 2019, during the replacement of a fire hydrant at a worksite located at 23537 Lorain Road, North Olmsted, Ohio, the employer did not ensure an employee working inside a trench, with a varying depth of approximately 5.5 to 6.5 feet deep and near 90 degree vertical walls, were protected from cave-ins by an adequately designed protection system. The soil would have been classified as; Cohesive Soil, type B .

29 CFR 1926.652(e)(1)(ii): Support systems shall be installed and removed in a manner that protects employees from cave-ins, structural collapses, or from being struck by members of the support system. On or about September 17, 2019, during the replacement of a fire hydrant at a worksite located at 23537 Lorain Road, North Olmsted, Ohio, the employer did not ensure an employee installed a hydraulic shoring cave-in protection system in a manner that protected them from cave-ins. The employee installed the hydraulic shoring system from a ladder while working inside an approximately 5.5 to 6.5 foot deep trench.
