29 CFR 1910.178(m)(4): The employer shall prohibit arms or legs from being placed between the uprights of the mast or outside the running lines of the truck. a) On or about September 16, 2019, the employer did not ensure that the operator of the Yale stand up forklift were protected from struck by hazards, in that the metal mesh screen did not extend upward to protect the employee from the movement of the mast.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. a) The employer did not report an injury within twenty-four (24) hours of an employee being injured, treated and lost of work days, in that an injury occurred on September 6, 2019 and the hospitalization was not reported until September 17, 2019.
