29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  On or before September 16, 2019, located at 1290 Sutton Rd., Cincinnati, OH, an employee was exposed to a cave-in hazard while working inside an excavation that was 16 feet deep in that the employee had not been trained on the applicable procedures or regulation to minimize those hazards associated with trenching and excavation such as but not limited to cave-in protection, and means of egress.

29 CFR 1926.651(b)(1): The estimated location of utility installations, such as sewer, telephone, fuel, electric, water lines, or any other underground installations that reasonably may be expected to be encountered during excavation work, shall be determined prior to opening an excavation.  On or before September 16, 2019, located at 1290 Sutton Rd., Cincinnati, OH, the employer did not verify or locate the reasonably expected utilities to be encountered such as electrical and gas lines prior to performing underground excavation while operating a John Deere Hydraulic Excavator.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.  On or before September 16, 2019, located at 1290 Sutton Rd., Cincinnati, OH, an employee was exposed to cave-in hazards as there were no inspections conducted by a competent person to evaluate for the need of a protective system, suitable means of access or egress of the excavation, and adequate precautions taken to protect against hazardous atmospheres, or other hazardous conditions.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:  On or before September 16, 2019, located at 1290 Sutton Rd., Cincinnati, OH, an employee working in an excavation 16 feet in-depth without adequate protection against cave-ins, in that the walls of the excavation were not properly sloped shored, benched or otherwise adequately protected against collapse.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  On or before September 16, 2019, located at 1290 Sutton Rd., Cincinnati, OH, an employee was using an extension ladder to access and egress an excavation in that the extension ladder side rails did not extend 3 feet past the upper landing surface to assist employees in mounting and dismounting the ladder.
