Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: a) On or about September 20, 2019, the employer, Mile High Landscaping, LLC, did not ensure employees were protected from falls of approximately 19 feet while engaged in elastomeric roof coating operations.

29 CFR 1910.1200(g)(1): Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use: a) On or about September 20, 2019, the employer, Mile High Landscaping, LLC, did not ensure safety data sheets were kept in the workplace for each hazardous chemical in use. Employees were spraying Henry Dura-Bright Elastomeric Roof Coating Paint while engaged in roof coating operations. Note: The requirements applicable to construction work under 29 CFR 1926.59 are identical to those set forth at 29 CFR 1910.1200 of this chapter.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a) On or about September 20, 2019, the employer, Mile High Landscaping, LLC, did not ensure employees received effective hazard communication training when exposed to hazardous chemical constituents including, but not limited to, titanium dioxide, limestone, ethylene glycol and a proprietary blend of latex polymers contained in Henry Dura-Bright Elastomeric Roof Coating. Employees were using this product while engaged in roof coating operations. Note: The requirements applicable to construction work under 29 CFR 1926.59 are identical to those set forth at 29 CFR 1910.1200 of this chapter.
