OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards from stone slabs:       Stone Yard Storage Area - On or about September 17, 2019, an employee was working with a forklift operator to remove and replace stone slabs from a storage rack. This employee was exposed to being potentially being crushed by a slab falling.

29 CFR 1910.136(a): The employer did not ensure that each affected employee used protective footwear when working in areas where there was a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, and where such employee's feet were exposed to electrical hazards:    Facility - On or about September 17, 2019, employees performing "spotter duties" were exposed to foot injuries while the employee was required to walk next to the forklift which had an elevated stone slabs and the exposed employee was without adequate foot protection.

29 CFR 1910.135(a)(1): The employer shall ensure that each affected employee wears a protective helmet when working in areas where there is a potential for injury to the head from falling objects:    Facility - On or about September 17, 2019, employees were exposed to head injuries while performing the "spotter's duty," where the employee was working underneath the elevated forks and load of the forklift during the placement and transporting of the stone slabs.

The employer did not ensure that the employees understood the hazards associated with operating forklift and the means necessary to minimize or eliminate those hazards.

29 CFR 1910.178(p)(1):Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition:    Toyota Fork Truck (S/N 80259) - On or about September 17, 2019, the Braxtion-Bragg telescopic pole was used to lift, transport, and lower stone slab loads while the boom was not attached or secured to the forklift. Additionally, the shackle utilize to support the yellow granite slab clamp device was extremely worn.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service and were placed in service when the examination showed condition(s) that would adversely affect the safety of the vehicle. Examinations were not made at least daily. Where industrial trucks are used on a round-the-clock basis, they were not examined after each shift:     Toyota Fork Truck (S/N 80259) - On or about September 17, 2019, the forklift was not adequately inspected in that the boom extension was not examined prior to being placed in service to ensure that the attachment was adequately attached to the forklift. Additionally, the shackles utilized for connecting and support the granite slab clamping device to the boom extension was extremely worn and not inspected or removed from service frequent use with the forklift.
