29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a) Ricardo Flores located at 6861 Bay Forest drive, Westerville, OH 43082:  On and preceding September 18, 2019, employees were installing shingles for a re-roof on the roof of a ranch-style residential home at heights up to 22 feet without fall protection or other PPE. The employer did not initiate and maintain safety and health programs related to the roofing work being conducted by employees.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Ricardo Flores located at 6861 Bay Forest drive, Westerville, OH 43082:  On and preceding September 18, 2019, the employer did not instruct employees in the recognition and avoidance of unsafe conditions and the procedures to be followed in order to minimize these hazards. Roofers were installing shingles on a roof that varied from 10-22 feet with the employees working at different levels. The employees were not utilizing proper eye, head or fall protection which exposed them to falls up to 22 feet and struck by hazards to the eyes.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Ricardo Flores located at 6861 Bay Forest drive, Westerville, OH 43082:  On and preceding September 18, 2019,  the employer did not ensure that employees working in areas where there was a possible danger of eye injury from impact, or flying objects utilized eye protection. Roofers were installing roofing shingles utilizing a pneumatic nail gun set at 90 psi and were not utilizing eye protection which exposed the them to struck by hazards to the eyes.

Roofers were installing shingles and flashing on a roof that varied from 10-22 feet without utilizing proper fall protection which exposed them to falls up to 22 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Ricardo Flores located at 6861 Bay Forest drive, Westerville, OH 43082:  On and preceding September 18, 2019,  the employer did not ensure that the portable ladder used to gain access to the roof extended at least three feet beyond the eave that they were using for access.  The eave of the roof measured 10 feet above the ground level where the ladder extended 20 inches beyond.  The following condition exposed employees to falls up to 10 feet.
