OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  a.  On or about September 18, 2019, at the jobsite, an employee was operating a John Deere Wheel Loader with a root grapple attachment attached, while a second employee was standing on the attachment without fall protection, as it was raised 13 feet off the ground. The exposed employee was standing between the metal tines of the attachment while he operating a chain saw to trim palm trees. The employee using the chain saw, while standing on the raised attachment, was exposed to fall hazards, impalement hazards and amputation hazards.

29 CFR 1910.135(a)(1): The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:  a.  On or about September 18, 2019, at the jobsite, an employee was operating a chain saw while trimming palm trees and the employee was not wearing a hard hat. The exposed employee was standing on root grapple attachment attached to a John Deere Wheel Loader and the attachment was raised to 13 feet of the ground. The employee was exposed to struck-by hazards from the palm trees.

On or about September 18, 2019, at the jobsite, an employee was operating a John Deere Wheel Loader with a root grapple attachment attached, while a second untrained employee was standing on the attachment without fall protection, as it was raised 13 feet off the ground. The exposed employee was standing between the metal tines of the attachment while he operating a chain saw to trim palm trees.
