29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about September 18, 2019, employees were exposed to a cave in while performing excavation work at a commercial building located at 1601 Portage Trail, Cuyahoga Falls, Ohio 44223. The employees were in a 6.5 feet deep trench and the employer did not ensure cave in protection was in place.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. On or about September 18, 2019, employees were exposed to a fall of approximately 6.5 feet while performing excavation work at a commercial building located at 1601 Portage Trail, Cuyahoga Falls, Ohio 44223. The employees were using a ladder to access a trench and the employer did not ensure that it extended 3 feet above the landing area.
