(a) In the trench - On or about September 18, 2019, the employer did not ensure the use of hardhats by employees who were exposed to being struck by wet soil inside the trench.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. (a) Inside the trench - On or about September 18, 2019, the competent person did not remove employees from the trench despite a rainstorm resulting in water accumulating in the trench and no cave-in protection for the excavation containing wet sand, resulting in a struck-by and engulfment hazard.
