29 CFR 1926.502(h)(1): The employer did not ensure that the safety monitor complied with the requirements listed in (h)(1)(i) through (h)(1)(v) of this section: Or in the alternative 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone: (a) On September 13, 2019, and at times prior for an employee who was hospitalized from a fall of approximately 17 foot fall while installing RPS on a narrow working area with a 1 foot parapet wall outside of a guardrail system, where the safety monitor was unable to view all employees he was monitoring in the same line of sight, and where the safety monitor was not able to easily communicate orally with the employees due to wind noise in the vicinity of Sheyenne Street & 32nd Avenue South in Fargo, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1196959, Citation 1, Item 1, and was affirmed as a final order on February 16, 2017, with respect to a workplace located at 1721 Main Avenue East, West Fargo, North Dakota.
