29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purpose for which they were designed: On or about September 17, 2019, the top half of a 32 ft. aluminum extension ladder (unknown manufacturer) was being used as a straight ladder. Employees completing construction activities at a residential property located at 2782 Grafton Rd. in Brunswick, OH, were using the top half of the ladder for access/egress to the top of the garage roof, which was not the purpose for which the ladder was designed.

29 CFR 1926.1053(b)(15): Ladder(s) were not inspected by a competent person for visible defects on a periodic basis and after an occurrence that could have affected their safe use: On or about September 17, 2019, at a residential property located at 2782 Grafton Rd., in Brunswick, OH, extension ladders used to access the upper landing surface were not inspected prior to use. The ladders, which were being used by employee tasked with installing siding around the chimney were defective in that: a. Rungs for the ladders were damaged and bent; b. Instead of removing a damaged ladder from service, a rung was replaced with inferior metal tubing the was showing signs of fatigue; c. Slip-resistant material was missing from the feet of several of the company's ladders.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identified them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired: On or about September 17, 2019, at a residential property located at 2782 Grafton Rd., in Brunswick, OH, portable extension ladders with structural defects were not withdrawn from service until repaired. The defective condition of the ladders includes, but is not limited to; damaged and bent rungs, a rung that was replaced with inferior metal tubing that was showing signs of fatigue, and the slip-resistant material was missing from the feet on several of the company's ladders. The ladders were not marked " Defective, Do not Use", and continued to be used by employees tasked with completing construction activities.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface were not used: On or about September 17, 2019, the employer failed to ensure that employees working from a ladder jack scaffold had a third ladder to use as a means of access and egress. Employees were exposed to a fall from a height of approximate 14 ft. Pence Brothers Siding Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.451(e) (1), which was contained in OSHA inspection number 11322587, citation number 1, item number 1 and was affirmed as a final order on August 20, 2018, with respect to a workplace located at 12677 Ponderosa Dr., North Royalton, OH 44133.
