29 CFR 1926.454(b): The employer shall have each employee who is involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question. The training shall include the following topics, as applicable; the nature of scaffold hazards; the correct procedures for erecting, disassembling, moving, operating, repairing, inspecting, and maintaining the type of scaffold in questions; the design criteria, maximum intended load-carrying capacity and intended use of the scaffold; any other pertinent requirements of this standard:    The employer did not ensure employees engaged in erecting, disassembling, moving, and working from a tubular welded frame scaffolding to install steel roofing and siding were trained in the nature of scaffold hazards, the correct procedures for erecting, disassembling, moving, operating, repairing, inspection and maintaining the scaffold, the maximum intended load-carrying capacity, and the intended use of the scaffold.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports as follows:    On or about September 18, 2019, employees utilized a tubular welded frame scaffolding to install standing seam metal roofing and access the patio roof surface located at 3131 Bluetopaz Dr. Appleton, WI without fully planking or decking the working level of the scaffold.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, and uprights shall bear on base plates and mud sills or other adequate firm foundation.  On or about September 18, 2019, employees utilized a tubular welded frame scaffolding to install standing seam metal roofing and to access the patio roof located at 3131 Bluetopaz Dr. Appleton, WI.  The scaffolding had three caster wheels and a screw jack on soil ground without base plates or mud sills to provide a firm adequate foundation.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  On or about September 18, 2019, employees working from a tubular welded frame scaffolding were exposed to fall hazards of over 10 feet without any form of fall protection while installing standing seam metal roofing on a patio roof located at 3131 Bluetopaz Dr. Appleton, WI.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  On or about September 18, 2019, employees working from a patio roof located at 3131 Bluetopaz Dr. Appleton, WI were exposed to fall hazards of approximately 11.5 feet without any form of fall protection while installing standing seam metal roofing.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.
