29 CFR 1910.22(a)(3): Walking-working surfaces were not maintained free of hazards such as sharp or protruding objects, loose boards, corrosion, leaks, spills, snow, and ice:                    a) Production, 1st Floor - On or about September 20, 2019, walking and working surfaces were not free of water.  Water was observed on the 1st floor near the Line 1 scale and in the pathway of forklifts.   Employees were exposed slip and fall hazards, and the loss of control of material handling devices, including forklifts.

29 CFR 1910.22(d)(1):  Walking-working surfaces are inspected, regularly and as necessary, and maintained in a safe condition.  a) Warehouse - On or about September 20, 2019, the warehouse floor was not maintained in a safe manner as there were holes throughout the area.  Employees are thereby exposed to hazards associated with trips and falls, and the control of material handling devices, including forklifts.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed.    a) First Floor - On or about September 20, 2019, the employer failed to ensure periodic inspections of the energy control procedure was performed at least annually for Henchal Mixers 5 and 6, and Mixaco Mixer 7 to ensure that the procedure and requirement of this standard were being followed.    b) Third Floor - On or about September 20, 2019, the employer failed to ensure periodic inspections of the energy control procedure was performed at least annually for Henchal Mixers 1, 2 and 3 to ensure that the procedure and requirement of this standard were being followed.

29 CFR 1910.147(c)(8): Lockout or tagout was not performed only by the authorized employees who are performing the servicing or maintenance.    a) Blending Area - On or about September 18, 2019, the employer failed to ensure the authorized employee assigned the task of cleaning Mixer 1 performed lockout on the machine.  The supervisor applied the lock and kept possession of the key, thereby exposing the employee to the unexpected energizing, start up or release of stored energy.
