29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  On or about September 18, 2019, the employer failed to ensure employees utilized extension ladders that extended three (3) feet above the landing surface. Employees used a four (4) foot step ladder to gain access to an approximate 8 foot 8 inch landing surface.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:  On or about September 18, 2019, the employer failed to ensure employees did not use a four (4) foot step ladder to gain access to an approximate 8 foot 8 inch landing surface. Employees had to climb onto the top step of the ladder in order to pull themselves up.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards.  On or about September 18, 2019, the employer failed to ensure employees were trained to on how to recognize and avoid hazards with ladders. Employees had to climb onto the top step of the ladder in order to pull themselves up.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest system:  On or about September 18, 2019, the employer failed to ensure employees performing carpentry work on rafters were protected from falls of approximately 8 feet 8 inches by utilizing fall protective systems/devices.   Stoney Acres Building, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1262122, citation number 001, item number 01 and was affirmed as a final order on November 3, 2017, with respect to a workplace located at 6950 Kingswood Road, Hudson, Ohio 44236.
