29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system. a) Randy Evans Construction located at 5063 State Route 93, Oak Hill, OH 45656: On and preceding September 24, 2019, the controlling employer did not ensure that employees engaged in a roof tear off on a low slope roof less than 50 feet in width were protected from falls by use of a safety monitor or other means of fall protection. Approximately 9 employees were removing shingles and sweeping a roof that was 12 feet 6 inches high with the worker designated as the safety monitor actively engaged in sweeping the roof. The following condition exposed employees to falls of 12-13 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) Randy Evans Construction located at 5063 State Route 93, Oak Hill, OH 45656: On and preceding September 24, 2019, the controlling employer did not ensure that the portable ladder used to gain access to the roof extended at least three feet beyond the eave that they were using for access. The eave of the roof measured 12'6" above the ground level where the ladder extended 18 inches beyond the eave. The following condition exposed employees to falls of 12-13 feet.
