29 CFR 1910.28(b)(15): Walking-working surfaces not otherwise addressed.  Except as provided elsewhere in this section or by other subparts of 29 CFR part 1910, the employer must ensure each employee on a walking-working surface 4 feet (1.2 m) or more above a lower level is protected from falling by:    i) Guardrail System;  ii) Safety net system; or  iii) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems.     a) On 9/14/2019 the employer did not ensure employees working in a racking system approximately six feet above a concrete flooring was protected from falling.  An employee was retrieving tires from a racking system.  The employee climbed on top of the Walkie (model #RPXT2W2G60BV), then climbed up in the racking system, the employee was standing on a tire in the second tier, while trying to retrieve a tire on the third tier.

29 CFR 1910.30(a)(1):  Fall hazards.  Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart.  Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017.    a) On or about 9/14/2019 the employer did not provide training for employees who utilize personal fall protection systems while retrieving tires from the three tiered racking system, as result, an employee fell from the second tier of the racking system (approximately 6').  The employee climbed on top of the Walkie (model #RPXT2W2G60BV), then climbed up in the racking system, the employee was standing on a tire in the second tier(that was hanging over the edge).
