29 CFR 1926.20(b)(2): (Accident prevention responsibilities.) Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On or about the 52-day period of Sep. 6 - Oct. 28, 2019, located on the residential roof structures of Bldgs. 4, 8, 11, and 15, there were no frequent and regular inspections being performed by a competent person in that employees: were performing roofing or framing work at elevation, over a 7-week period throughout the property, while not utilizing an effective fall protection system and exposed to potential falls greater than 6 feet above ground level; were not provided an effective fall protection system before performing roofing and framing work at elevation; and were not properly supervised at the site by either the owner or foreman.

29 CFR 1926.502(a)(2): ("General.") Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection.   On Oct. 28, 2019, located at the residential roof structure of Bldg. 5, employees were not provided with fall protection equipment before beginning framing work at potential fall heights of 8'10" above ground level.

29 CFR 1926.503(a)(1): ("Training Program.") The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.      The employer did not provide an effective training program for employees performing framing work from a steep pitch residential roof structure while not utilizing a fall protection system and exposed to potential fall heights of 8'10" above ground level.

29 CFR 1926.503(b)(1): ("Certification of training.") The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  The employer did not have written certification of fall protection training for one employee performing framing work on a residential roof structure while not utilizing a fall protection system and exposed to potential fall heights of 8'10" above ground level.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a) On or about Sep. 6, 2019, located on the roof structures of Bldgs. 4 & 15, employees were performing roofing work from a roof structure with unprotected sides and edges while not utilizing a fall protection system and exposed to potential falls greater than 6 feet above ground level.  (b) On or about Oct. 7, 2019, located on the roof structure of Bldg. 11, employees were performing roofing work from a roof structure with unprotected sides and edges while not utilizing a fall protection system and exposed to potential falls greater than 6 feet above ground level.  (c) On or about Oct. 8, 2019, located on the roof structure of Bldg. 11, employees were performing roofing work from a roof structure with unprotected sides and edges while not utilizing a fall protection system and exposed to potential falls greater than 6 feet above ground level.  (d) On or about Oct. 18, 2019, located on the roof structure of Bldg. 8, employees were performing roofing work from a roof structure with unprotected sides and edges while not utilizing a fall protection system and exposed to potential falls greater than 6 feet above ground level.  (e) On or about Oct. 21, 2019, located on the roof structure of Bldg. 8, employees were performing roofing work from a roof structure with unprotected sides and edges while not utilizing a fall protection system and exposed to potential falls greater than 6 feet above ground level.  (f) On or about Oct. 25, 2019, located on the roof structure of Bldg. 8, employees were performing framing work from a roof structure with unprotected sides and edges while not utilizing a fall protection system and exposed to potential falls greater than 6 feet above ground level.  (g) On Oct. 28, 2019, located on the northwest side of Bldg. 5, employees were performing framing work from a steep pitch roof with unprotected sides and edges while not utilizing a fall protection system and exposed to potential falls of 8'10" above ground level.  Santiago Cleaning, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1338114, citation number 1, item number 1 and was affirmed as a final order on 11/20/2018, with respect to a workplace located at Bldg # 3, Red Gate Lane, Dayton OH 45458.
